Laser doing 90kph in a 60kph

Postby Jez » Mon Sep 05, 2011 10:10 am

I was pulled over 16/08, infringement notice says detected at 90kph, alleged 88kph. Was in a 60kph zone. Is there any harm in writing a letter to Civic Compliance (without admitting guilt) but requesting a warning given the distance at which I was detected (over 200m according to the cop), other traffic around, good driving record, safe modern car, the fact that the area was 80kph last time I drove there?
Thanks, Jez

Simple answer, no it wont do any good. Its not in the eligible criteria for a warning.

How to get a warning for a traffic offence.

Postby Hardy » Mon Sep 05, 2011 12:49 pm

There are only three ways to get a warning.

1. Your speed is less than 10kmh over the limit and you have had no infringements for 2 years, or
2. You have got several 1 point speeding fines on the freeway within a few weeks and you want a warning on most of them, or
3. You are homeless or you have been diagnosed with a mental illness or a serious drug addiction such that you were not able to control the conduct that resulted in you offending (this is not going to work with a typical traffic offence).

If you don't meet the above criteria then don't bother asking for a warning.
